These Terms of Service ("Terms") constitute a legally binding agreement between you and Lustyn Ltd (Company No. SC861042), a company registered in Scotland under the laws of the United Kingdom. By accessing or using the Lustyn platform, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not access or use our services.
Age Requirement and Legal Notice
You must be at least 18 years old to use Lustyn. By using this platform, you represent and warrant that you are 18 years of age or older and legally permitted to view and access adult content in your jurisdiction. Lustyn is an adult entertainment platform and all content is intended exclusively for adults.
1. Account Requirements and Eligibility
1.1 Age and Legal Capacity
You must be at least 18 years old to create an account or use Lustyn. By creating an account, you represent and warrant that:
- You are at least 18 years of age;
- You possess the legal capacity to enter into these Terms under the laws of your jurisdiction;
- You are legally permitted to view, access, and interact with adult content in your jurisdiction;
- All information you provide during registration is accurate, complete, and truthful;
- You will maintain the accuracy of such information throughout your use of the platform.
1.2 Age Verification
Lustyn employs third-party age verification services to confirm that all users meet our minimum age requirements. By creating an account, you expressly consent to:
- Age verification through approved third-party verification providers;
- The sharing of necessary personal information with such verification services as required to confirm your age;
- Our right to deny registration or terminate accounts that fail verification;
- Additional verification requests at any time during your use of the platform.
We maintain strict compliance with UK law regarding adult content access and age verification requirements. Failure to complete or pass age verification will result in denial or termination of platform access.
1.3 Account Security and Responsibility
You are solely responsible for:
- Maintaining the confidentiality and security of your account credentials;
- All activities that occur under your account, whether authorized by you or not;
- Notifying us immediately of any unauthorized access to or use of your account;
- Ensuring your account information remains accurate, current, and complete at all times.
You agree that Lustyn shall not be liable for any loss or damage arising from your failure to comply with these security obligations.
2. Account Registration and Verification
2.1 Registration Process
To register for and use Lustyn, you must:
- Provide accurate, complete, and truthful registration information;
- Successfully complete age verification through our approved verification providers;
- Accept and agree to these Terms of Service and our Privacy Policy;
- Create a secure password and maintain its confidentiality;
- Not register for multiple accounts or use another person's account without authorization.
2.2 Verification Requirements
Our age verification process may require one or more of the following:
- Government-issued photographic identification;
- Facial recognition or biometric verification;
- Credit card or payment card verification;
- Other verification methods approved by UK regulatory authorities or deemed necessary by Lustyn.
All verification data is handled securely and in strict accordance with our Privacy Policy and UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
2.3 Account Approval and Denial
Lustyn reserves the right, in its sole discretion, to:
- Approve or deny any account registration without providing a reason;
- Request additional verification or information at any time;
- Suspend accounts pending completion of verification;
- Terminate accounts that fail to meet our verification or eligibility requirements;
- Refuse service to any individual or entity.
3. Privacy and Data Protection
3.1 Privacy Policy
Your use of Lustyn is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains in detail how we collect, use, store, and protect your personal information.
3.2 Data Protection Rights
Under UK data protection legislation, including the UK GDPR and the Data Protection Act 2018, you have the following rights:
- The right to access your personal data;
- The right to rectify inaccurate personal data;
- The right to erasure of your personal data in certain circumstances;
- The right to restrict processing of your personal data;
- The right to data portability;
- The right to object to processing of your personal data;
- The right to withdraw consent at any time where processing is based on consent.

3.3 Cookies and Tracking Technologies
We use cookies and similar tracking technologies as described in our Privacy Policy and Cookie Policy. By using Lustyn, you consent to our use of such technologies in accordance with applicable UK law.
4. Acceptable Use Policy
4.1 Permitted Use
Lustyn is intended exclusively for:
- Adults aged 18 and over to share and view consensual adult content;
- Social networking and interaction within our community guidelines;
- Legal adult entertainment purposes in compliance with UK law.
4.2 Prohibited Use
You are expressly prohibited from using Lustyn to:
- Post, share, distribute, or access illegal content under UK law;
- Harass, threaten, intimidate, or abuse other users;
- Impersonate any person or entity or provide false or misleading information;
- Engage in spam, scams, fraud, or any fraudulent activity;
- Circumvent, disable, or interfere with age verification or other security measures;
- Scrape, copy, harvest, or collect data from the platform through automated means;
- Use automated tools, bots, scripts, or other automated means without our express written authorization;
- Interfere with, disrupt, or compromise the platform's operation, security, or integrity;
- Violate any applicable laws, regulations, or third-party rights;
- Attempt to gain unauthorized access to any portion of the platform or any other systems or networks.
5. Content Guidelines
5.1 User-Generated Content
Users may upload, post, and share photos, videos, text, and other content ("User Content"). By posting User Content on Lustyn, you:
- Grant Lustyn a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, display, reproduce, modify, adapt, and distribute your User Content for the purpose of operating and providing our services;
- Represent and warrant that you own all rights in your User Content or have obtained all necessary rights, licenses, consents, and permissions to post it;
- Confirm that all individuals depicted in your User Content are at least 18 years of age and have provided informed consent to be depicted and for the content to be shared on Lustyn;
- Accept full responsibility and liability for your User Content and its consequences.
5.1.1 Public Profile Display
By creating a Lustyn account, you understand and agree that your profile information, including your username/display name, profile pictures, and general location (if location sharing is enabled in your settings), may be displayed publicly on our platform, including on our welcome page and promotional materials, to showcase our community to visitors and potential new members. You retain full control over your location sharing settings and can disable public location display at any time through your account settings. Users who have disabled location sharing will have their privacy preferences respected in all public displays. You may also opt out of public profile display entirely through your privacy settings.
5.2 Prohibited Content
The following categories of content are strictly prohibited on Lustyn and will result in immediate content removal, account termination, and, where applicable, reporting to law enforcement authorities:
- Child Sexual Abuse Material (CSAM): Any content depicting, promoting, or facilitating child sexual exploitation or abuse. This includes any sexual or sexually suggestive content involving individuals under 18 years of age. This is a serious criminal offence under UK law and will result in immediate account termination, content removal, and mandatory reporting to the National Crime Agency (NCA) and other relevant law enforcement authorities.
- Images of Minors (Under 18): Lustyn is an adult-only platform (18+). No images, videos, or other content depicting individuals under 18 years of age are permitted under any circumstances, even if non-sexual in nature (e.g., family photos, birthday parties, etc.). This policy exists to maintain the adult-only nature of our platform and to prevent any potential misuse. Violations will result in immediate content removal and may result in account suspension or termination.
- Non-Consensual Intimate Images: Any intimate or sexual content shared without the informed consent of all depicted individuals, including so-called "revenge porn".
- Deepfakes and Manipulated Content: Artificially generated or manipulated sexual or intimate content created without the consent of the depicted individual.
- Violent or Extreme Content: Content depicting, promoting, or glorifying violence, gore, serious harm, or death.
- Bestiality: Any sexual content involving animals.
- Incest: Content depicting or promoting incestuous relationships.
- Illegal Activities: Content promoting, facilitating, or depicting criminal behavior under UK law.
- Hate Speech: Content that promotes hatred, discrimination, or violence against individuals or groups based on protected characteristics including race, ethnicity, national origin, religion, disability, sex, sexual orientation, or gender identity.
- Terrorism: Content promoting, glorifying, or facilitating terrorist activities or organizations proscribed under UK law.
- Self-Harm and Suicide: Content encouraging, promoting, or providing instructions for suicide or self-harm.
- Exploitation and Trafficking: Content involving human trafficking, exploitation, coercion, or any form of modern slavery.
- Extreme Pornography: Content that is illegal under the Criminal Justice and Immigration Act 2008 or other UK legislation.
5.3 Content Moderation
Lustyn reserves the right, but is not obligated, to:
- Monitor, review, and moderate any content posted on the platform;
- Remove any content that violates these Terms, UK law, or our community standards;
- Suspend or permanently terminate accounts for violations;
- Report illegal content to appropriate law enforcement and regulatory authorities;
- Preserve evidence of violations for legal and regulatory purposes;
- Cooperate fully with law enforcement investigations.
Content moderation decisions are made at our sole discretion. We are not liable for any failure to remove content or for any action taken regarding content.
5.4 Content Ownership and License
You retain ownership of your User Content. However, by posting User Content on Lustyn, you grant us the licenses specified in Section 5.1. This license continues until you delete the content or terminate your account, except that it may continue for content that has been shared or distributed to other users.
6. User Conduct
6.1 Expected Behavior
All users are expected to:
- Treat other users with respect and dignity;
- Communicate honestly, transparently, and in good faith;
- Respect the boundaries, consent, and autonomy of other users;
- Comply with all applicable UK laws and regulations;
- Report violations, illegal content, or safety concerns to our safety team promptly.
6.2 Prohibited Conduct
The following behaviors are strictly prohibited:
- Harassment and Abuse: Bullying, stalking, threatening, or intimidating other users.
- Discrimination: Discriminatory behavior or speech based on protected characteristics.
- Fraud and Deception: Scams, financial fraud, identity theft, or other deceptive practices.
- Spam: Unsolicited commercial messages, repetitive content, or bulk messaging.
- Illegal Solicitation: Advertising or soliciting prostitution, escort services, or other illegal services.
- Doxxing: Publishing or threatening to publish private or identifying information about others without consent.
- Impersonation: Pretending to be another person, entity, or Lustyn representative.
- Platform Circumvention: Attempting to bypass, disable, or circumvent platform security measures, restrictions, or bans.
- Market Manipulation: Engaging in any conduct intended to artificially inflate engagement or manipulate platform metrics.
6.3 Enforcement and Consequences
Violations of these Terms may result in one or more of the following consequences, at Lustyn's sole discretion:
- Formal warning notices;
- Immediate content removal;
- Temporary suspension of account access;
- Permanent account termination and ban;
- Reporting to law enforcement and regulatory authorities;
- Legal action to recover damages or obtain injunctive relief.
The severity of consequences will be determined based on the nature and severity of the violation.
7. Intellectual Property
7.1 Platform Intellectual Property Rights
All intellectual property rights in the Lustyn platform, including but not limited to:
- The Lustyn name, logo, trademarks, and branding;
- Platform design, layout, user interface, and visual elements;
- Software, source code, object code, and algorithms;
- Original content, text, graphics, and audiovisual materials created by Lustyn;
- Databases, data compilations, and data structures;
are owned by or licensed to Lustyn Ltd and are protected by UK and international intellectual property laws, including copyright, trademark, and database rights. You may not use, copy, reproduce, modify, distribute, or create derivative works of any of our intellectual property without our express prior written permission.
7.2 User Content License Grant
By posting User Content on Lustyn, you grant Lustyn a non-exclusive, transferable, sublicensable, royalty-free, perpetual (until deletion), worldwide license to:
- Host, store, cache, and display your User Content;
- Reproduce and distribute your User Content to other platform users;
- Modify, adapt, or reformat your User Content for technical or operational purposes;
- Use your User Content for platform promotion and marketing purposes, subject to your privacy settings and with your consent where required by law.
This license terminates when you delete your User Content or terminate your account, except where content has been shared or distributed to other users or is required to be retained for legal or regulatory compliance.
7.3 Copyright Infringement and DMCA
Lustyn respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and UK copyright law. If you believe that content on Lustyn infringes your copyright:
- Submit a notice to [email protected];
- Provide detailed information about the alleged infringement, including the location of the infringing content;
- Include proof of your ownership or authorization to act on behalf of the copyright owner;
- Provide your contact information and a statement of good faith belief that the use is unauthorized;
- Include a statement under penalty of perjury that the information is accurate and you are authorized to act.
We will investigate all properly submitted notices and take appropriate action, which may include removing or disabling access to the allegedly infringing content. Repeat copyright infringers will have their accounts permanently terminated.
7.4 Counter-Notification
If you believe content you posted was wrongly removed due to a copyright claim, you may submit a counter-notification to [email protected] in accordance with DMCA procedures and UK law.
8. User Reporting and Content Moderation
8.1 Reporting Mechanisms
Users can report violations of these Terms or illegal content through the following mechanisms:
- In-platform reporting tools available on each post and user profile;
- Email to [email protected] with detailed information about the violation.
When submitting a report, please provide as much detail as possible, including the nature of the violation, the location of the content, and any supporting evidence.
8.2 Report Review and Processing
When you submit a report:
- Our moderation team will manually review the reported content within a reasonable timeframe;
- We will assess whether the content violates these Terms or UK law;
- If a violation is confirmed, the content will be removed and appropriate action will be taken against the account holder;
- All reports are treated seriously and investigated promptly, with priority given to reports of illegal content or serious safety concerns.
Due to the volume of reports, we may not be able to provide individual responses to every report, but all reports are reviewed.
8.3 Illegal Content Reporting
For reports of illegal content, particularly Child Sexual Abuse Material (CSAM), terrorism content, or other serious criminal content:
- The content is immediately removed upon confirmation;
- The account is permanently terminated and banned;
- We report the content and user details to the National Crime Agency (NCA) via their Child Exploitation and Online Protection (CEOP) command or other appropriate law enforcement authorities;
- Evidence is preserved and made available to law enforcement for investigation and prosecution;
- We cooperate fully with law enforcement throughout any investigation.
8.4 Appeals Process
If you believe that content was removed in error or that your account was wrongly suspended or terminated:
- Submit an appeal to [email protected];
- Include your account details, the specific content or action in question, and detailed reasoning for your appeal;
- Appeals will be reviewed by a member of our team who was not involved in the original decision;
- You will receive a response to your appeal within a reasonable timeframe.
Appeal decisions are final. We reserve the right to limit the number of appeals you may submit.
8.5 False Reporting
Deliberately filing false or malicious reports to harass other users, abuse the reporting system, or disrupt the platform is strictly prohibited and may result in action against your account, including warnings, suspension, or permanent termination.
9. Account Termination and Suspension
9.1 Termination by User
You may terminate your account at any time by:
- Using the account deletion feature in your account settings;
- Contacting [email protected] with a termination request.
Upon termination of your account:
- Your account will be permanently deactivated;
- Your User Content will be removed from public view;
- Some data may be retained for legal compliance, regulatory requirements, or legitimate business purposes as described in our Privacy Policy;
- The complete deletion process may take up to 30 days;
- Deletion is permanent and cannot be reversed.
9.2 Termination by Lustyn
Lustyn may suspend or terminate your account immediately and without prior notice if:
- You violate any provision of these Terms;
- You post prohibited content or engage in prohibited conduct;
- You engage in illegal activity on or through the platform;
- Your account poses a safety, security, or legal risk to Lustyn, other users, or third parties;
- We are required to terminate your account by law, regulation, or legal process;
- We cease operations or discontinue the platform;
- We determine, in our sole discretion, that termination is necessary or appropriate.
9.3 Effects of Termination
Upon termination of your account by either party:
- You immediately lose all access to your account and User Content;
- All licenses granted by you under these Terms continue for content that has not been deleted or that must be retained;
- You remain fully liable for any violations or breaches that occurred prior to termination;
- You may be permanently banned from creating new accounts on Lustyn;
- We may preserve evidence of violations for legal, regulatory, or evidentiary purposes;
- Outstanding obligations, including indemnification obligations, continue to apply.
9.4 Survival of Terms
The following provisions survive termination of these Terms or your account: Sections 5.1 (User Content licenses), 7 (Intellectual Property), 10 (Disclaimers and Limitation of Liability), 11 (Indemnification), 12 (Governing Law and Dispute Resolution), 14 (UK Online Safety Act Compliance), and any other provisions that by their nature should survive termination.
10. Disclaimers and Limitation of Liability
10.1 Service Provided "As Is"
Lustyn is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, or non-infringement;
- Warranties that the service will be uninterrupted, timely, secure, or error-free;
- Warranties regarding the accuracy, reliability, or completeness of any content, information, or materials;
- Warranties that defects or errors will be corrected;
- Warranties regarding the results that may be obtained from use of the service.
No advice or information, whether oral or written, obtained from Lustyn shall create any warranty not expressly stated in these Terms.
10.2 User Responsibility and Assumption of Risk
You acknowledge and agree that:
- You use Lustyn entirely at your own risk;
- We are not responsible for User Content or the conduct of any user;
- We do not verify the identity, claims, credentials, or background of users;
- Any interactions, transactions, or relationships with other users are entirely your responsibility;
- You are responsible for taking appropriate precautions and exercising caution in all interactions;
- We do not endorse any User Content, user, or opinion expressed on the platform.
10.3 Limitation of Liability
To the maximum extent permitted by applicable UK law, Lustyn and its officers, directors, employees, agents, affiliates, and licensors shall not be liable for:
- Any indirect, incidental, special, consequential, exemplary, or punitive damages;
- Loss of profits, revenue, data, goodwill, or other intangible losses;
- Service interruptions, errors, or unavailability;
- User conduct, content, or interactions;
- Third-party actions, content, or websites;
- Unauthorized access to or alteration of your data or communications;
- Any other matter relating to the platform or these Terms.
Our total aggregate liability to you for any and all claims arising from or relating to your use of Lustyn or these Terms shall not exceed the greater of: (a) the amount you paid us, if any, in the 12 months preceding the claim; or (b) £100.
10.4 Exceptions to Limitations
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Any liability that cannot be excluded or limited under UK law.
10.5 Basis of the Bargain
You acknowledge that the disclaimers and limitations in this Section 10 are fundamental elements of the agreement between you and Lustyn, and that Lustyn would not provide the platform to you without these limitations.
11. Indemnification
You agree to indemnify, defend, and hold harmless Lustyn Ltd and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees and court costs) arising from or relating to:
- Your access to or use of the platform;
- Your User Content;
- Your violation or breach of these Terms;
- Your violation of any rights of any third party, including intellectual property rights, privacy rights, or publicity rights;
- Your violation of any applicable laws, regulations, or rules;
- Any claim that your User Content caused damage to a third party;
- Your willful misconduct or negligence.
This indemnification obligation survives termination of these Terms and your account. Lustyn reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Scotland and the law of the United Kingdom applicable in Scotland.
12.2 Jurisdiction
You irrevocably agree that the courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims). Nothing in this clause shall limit our right to bring proceedings against you in any other court of competent jurisdiction.
12.3 Informal Dispute Resolution
Before initiating formal legal proceedings, you agree to first contact us at [email protected] to attempt to resolve any dispute, claim, or controversy informally. We will attempt to resolve the dispute through good faith negotiations for a period of 60 days.
12.4 Time Limitation on Claims
Any claim or cause of action arising from or relating to these Terms or your use of Lustyn must be filed within one year after the claim or cause of action arose, or it will be permanently barred, except to the extent such limitation is prohibited by applicable law.
12.5 Class Action Waiver
To the extent permitted by applicable law, all claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class, collective, representative, multiple plaintiff, or similar proceeding. The parties agree that there will be no class arbitration or arbitration in which an individual attempts to resolve a dispute as a representative of another individual or group of individuals.
13. Changes to Terms
13.1 Right to Modify
Lustyn reserves the right to modify, amend, or update these Terms at any time in its sole discretion. Changes will become effective:
- Immediately upon posting for minor, non-material changes that do not adversely affect your rights;
- 30 days after notice is provided for material changes that affect your rights or obligations.
13.2 Notice of Changes
For material changes to these Terms, we will provide notice by:
- Sending an email to the email address associated with your account;
- Displaying a prominent notice on the platform;
- Providing an in-app notification;
- Any combination of the above methods.
It is your responsibility to ensure your email address is current and to check for notices.
13.3 Acceptance of Changes
Your continued access to or use of Lustyn after the effective date of any changes to these Terms constitutes your acceptance of such changes. If you do not agree to the modified Terms, you must immediately stop using the platform and may terminate your account in accordance with Section 9.1.
13.4 Version Control
Each version of these Terms will be identified by its effective date and version number. Previous versions may be made available upon request to [email protected].
14. UK Online Safety Act Compliance
14.1 Regulatory Commitment and Framework
Lustyn Ltd is committed to full compliance with the Online Safety Act 2023 and operates under the regulatory oversight of the Office of Communications (Ofcom), the UK's online safety regulator. We recognize our legal duties as a Category 1 user-to-user service provider and take these obligations seriously.
14.2 Online Safety Compliance Officer
Ryan has been formally appointed as Lustyn's Online Safety Compliance Officer with responsibility for:
- Overseeing compliance with all requirements of the Online Safety Act 2023;
- Developing, implementing, and maintaining our safety policies and procedures;
- Coordinating with Ofcom, the National Crime Agency, and other law enforcement or regulatory authorities as required;
- Ensuring that illegal content and content harmful to children is identified, removed, and reported appropriately;
- Managing our risk assessment processes and safety measures;
- Maintaining records and documentation required under the Act.

14.3 Illegal Content Risk Assessment
In accordance with our duties under the Online Safety Act, Lustyn will:
- Complete a comprehensive illegal content risk assessment within 3 months of launching our service to users;
- Assess risks across all priority illegal content categories defined in Schedule 7 of the Online Safety Act, including but not limited: child sexual exploitation and abuse content, terrorism content, content facilitating serious violence, hate offences, fraud, drug offences, intimate image abuse, and other serious criminal content;
- Consider the level of risk of individuals encountering each category of priority illegal content on our service;
- Assess the likely impact on individuals if they were to encounter such content;
- Evaluate the risk of functionalities of our service facilitating the presence or dissemination of illegal content;
- Review and update our illegal content risk assessment at least annually;
- Update our assessment whenever we make significant changes to our service or become aware of new or increased risks;
- Maintain comprehensive records of our assessments and make them available to Ofcom upon request.
14.4 Children's Safety and Access Prevention
Given that Lustyn is a platform exclusively for adults hosting adult content:
- We employ robust age verification measures using approved third-party providers to prevent access by individuals under 18 years of age;
- We will complete a children's access assessment within 4 months of service launch to evaluate whether children are likely to access our service and whether our age verification measures are effective;
- We actively monitor for and prevent underage users from accessing our platform;
- Any suspected underage users are immediately reported to appropriate authorities and permanently banned;
- We will implement additional measures as necessary to ensure compliance with Ofcom's guidance on age verification and age assurance;
- We maintain records of our children's access assessments and verification systems.
14.5 Safety Measures and Systems
Lustyn implements and maintains the following safety measures in accordance with our duties under the Online Safety Act:
- User Reporting System: An accessible and easy-to-use in-platform reporting tool allowing users to report content that violates these Terms or UK law;
- Content Moderation: A trained moderation team that manually reviews all reported content to assess whether it constitutes illegal content or violates our Terms;
- Enforcement Actions: Swift removal of confirmed illegal or violating content and appropriate account-level actions including warnings, suspensions, and permanent bans;
- User Controls: Tools enabling users to block and unblock other users and control their interactions;
- Clear Terms and Community Standards: Comprehensive, accessible Terms of Service and community guidelines that clearly prohibit illegal content and harmful conduct;
- Law Enforcement Cooperation: Established processes for reporting serious criminal content, including CSAM and terrorism content, to the National Crime Agency and for cooperating with law enforcement investigations;
- Transparency: Regular transparency reporting on content moderation, reports received, and actions taken;
- Continuous Improvement: Regular review and enhancement of our safety systems based on emerging risks, user feedback, and regulatory guidance.
14.6 Illegal Content Handling Procedures
When illegal content is reported to us or identified through our proactive measures:
- The content is reviewed by our moderation team as a priority;
- Upon confirmation that content is illegal under UK law, it is immediately removed from the platform;
- The account of the user who posted the content is suspended or permanently banned depending on the severity;
- For Child Sexual Abuse Material (CSAM), we make an immediate report to the National Crime Agency via the Child Exploitation and Online Protection (CEOP) command;
- For terrorism content, we report to the appropriate Counter-Terrorism Internet Referral Unit (CTIRU) or other relevant law enforcement;
- For other serious criminal content, we assess whether reporting to law enforcement is required and report as appropriate;
- We preserve all relevant evidence, including content, metadata, and user information, for law enforcement investigations;
- We maintain detailed records of all reports, investigations, and actions taken;
- We cooperate fully with law enforcement throughout any investigation or prosecution.
14.7 Record-Keeping and Transparency
Lustyn maintains comprehensive records as required by the Online Safety Act, including:
- All user reports received, including the nature of reports and content reported;
- Actions taken in response to reports, including content removals and account enforcement;
- Our illegal content and children's access risk assessments and all updates;
- Documentation of our safety measures, systems, and processes;
- Reports made to law enforcement and regulatory authorities;
- Training provided to moderation and safety teams;
- Communications with Ofcom and responses to information requests.
These records are maintained securely and made available to Ofcom upon request in accordance with their information-gathering powers under the Act.
14.8 Compliance Timeline and Ongoing Obligations
Lustyn's compliance timeline and ongoing obligations include:
- At Service Launch: Age verification systems operational, user reporting system functional, moderation team trained, basic safety measures implemented, Terms of Service published;
- Within 3 Months of Launch: Completion and documentation of comprehensive illegal content risk assessment covering all priority illegal content categories;
- Within 4 Months of Launch: Completion of children's access assessment evaluating effectiveness of age verification measures;
- Ongoing Obligations: Annual review and update of risk assessments, continuous monitoring of the platform for safety risks, prompt response to all user reports, immediate action on illegal content, cooperation with Ofcom information requests and investigations, implementation of any additional measures required by Ofcom guidance or direction, transparency reporting, and continuous improvement of safety systems.
14.9 Cooperation with Regulatory and Law Enforcement Authorities
Lustyn is committed to full cooperation with UK regulatory and law enforcement authorities:
- We respond promptly and comprehensively to information requests from Ofcom;
- We report Child Sexual Abuse Material (CSAM) to the National Crime Agency via the CEOP command as required by law;
- We report terrorism content and other serious criminal content to appropriate law enforcement authorities;
- We provide evidence, records, and testimony when legally required or requested;
- We comply with lawful content removal orders and enforcement actions;
- We cooperate with investigations and proceedings brought by Ofcom or law enforcement;
- We implement any measures required by Ofcom's confirmation decisions, enforcement notices, or other regulatory actions.

As a user of Lustyn, you have the following rights under the Online Safety Act framework:

- We regularly update our safety measures, policies, and systems in response to identified risks;
- We learn from user reports, incidents, and enforcement actions to improve our processes;
- We stay informed about Ofcom guidance, codes of practice, and industry best practices;
- We invest in training for our moderation and safety teams;
- We engage with online safety experts and organizations to enhance our approach;
- We are responsive to emerging threats and adapt our measures accordingly.

16. General Provisions
16.1 Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or policies published by Lustyn, constitute the entire agreement between you and Lustyn Ltd concerning your use of the platform and supersede all prior agreements, understandings, and representations, whether written or oral, relating to the subject matter hereof.
16.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, such provision shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and the remaining provisions shall continue in full force and effect.
16.3 Waiver
No waiver by Lustyn of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by Lustyn to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. All waivers must be in writing and signed by an authorized representative of Lustyn.
16.4 Assignment
You may not assign, transfer, or sublicense these Terms or any of your rights or obligations hereunder without the prior written consent of Lustyn, and any attempted assignment, transfer, or sublicense without such consent shall be null and void. Lustyn may assign or transfer these Terms or any of its rights or obligations hereunder without restriction and without notice to you. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
16.5 No Third-Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person or entity other than you and Lustyn. No third party shall have any right to enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
16.6 Relationship of Parties
Nothing in these Terms shall be construed to create a partnership, joint venture, agency, franchise, employment, or fiduciary relationship between you and Lustyn. You have no authority to bind Lustyn or to act on behalf of Lustyn, and you shall not represent to any third party that you have such authority.
16.7 Force Majeure
Lustyn shall not be liable for any failure or delay in performance of its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, governmental actions, epidemics or pandemics, failure of telecommunications or internet infrastructure, or cyber-attacks. In such circumstances, Lustyn's obligations shall be suspended for the duration of the force majeure event.
16.8 Interpretation
The headings and section titles in these Terms are for convenience only and shall not affect the interpretation of these Terms. The words "including," "includes," and "include" shall be deemed to be followed by the phrase "without limitation." References to "writing" or "written" include email and other electronic communications.
16.9 Language
These Terms are drafted in the English language. If these Terms are translated into any other language, the English language version shall prevail to the extent of any conflict or inconsistency.
16.10 Notices
All notices, requests, and other communications under these Terms must be in writing and shall be deemed given: (a) when delivered personally; (b) when sent by confirmed email; (c) one business day after being sent by reputable overnight courier; or (d) three business days after being mailed by registered or certified mail, return receipt requested. Notices to Lustyn must be sent to [email protected] or to our registered office address. Notices to you may be sent to the email address associated with your account or by posting on the platform.
16.11 Electronic Communications
By using Lustyn, you consent to receiving electronic communications from us, including emails, notifications, and postings on the platform. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
16.12 Export Control
You may not use, export, re-export, import, or transfer the platform or any portion thereof except as authorized by UK law and the laws of the jurisdiction in which you obtained the right to use the platform. You represent and warrant that you are not located in a country subject to UK government embargo or designated as a "terrorist supporting" country, and that you are not listed on any UK government list of prohibited or restricted parties.
Acknowledgment and Acceptance
By creating an account on or using the Lustyn platform, you acknowledge that you have read these Terms of Service in their entirety, understand them, and agree to be legally bound by them. You further acknowledge that these Terms constitute a binding legal agreement between you and Lustyn Ltd.
If you do not agree to these Terms, you are not authorized to access or use Lustyn and must immediately cease all use of the platform.
